Terms and Conditions

Effective from 1 July 2026.

1. Provider

The FocuPlay platform (the "platform") is operated and its digital content provided by Focus People s.r.o., company ID (IČO): 02164469, VAT ID (DIČ): CZ02164469, registered office at Čalounická 477, 739 34 Šenov, Czech Republic, recorded in the commercial register kept by the Regional Court in Ostrava, Section C, File 66767 (the "provider").

2. Services

The platform provides online educational content — courses with pre-recorded lessons, live webinars, and individual consultations (the "services"). The description, scope, and price of each service are shown with the item in the catalog.

These terms govern the contractual relationship between the provider and the customer created by ordering a service on the platform.

3. Ordering and formation of the contract

The customer places an order on the platform by selecting a service and completing the payment. The contract is concluded when the provider confirms receipt of the payment; the customer receives the confirmation by e-mail together with the invoice.

A user account is required for purchases. The customer is responsible for the accuracy of the details in their account.

4. Prices and payment

Prices are shown in Czech crowns (CZK) with each service. The provider is a VAT payer; prices include VAT.

Payment can be made online by card or instant bank transfer through the Comgate payment gateway (operated by Comgate a.s.), or by bank transfer to the provider's account using the assigned variable symbol. For bank transfers, access is activated after the payment is received and verified.

Unpaid orders are cancelled automatically after the payment deadline stated in the payment instructions.

5. Delivery of digital content

Course access is activated immediately after payment confirmation by making the content available in the customer's account. For webinars and consultations, delivery means enabling participation at the stated time.

Using the services requires an internet connection and a standard web browser; connection costs are borne by the customer.

6. Withdrawal from the contract

A consumer has the right to withdraw from a distance contract within 14 days. By completing a course purchase, the customer expressly consents to the digital content being made available before the withdrawal period expires and acknowledges that the right of withdrawal is thereby extinguished (Section 1837(l) of the Czech Civil Code).

For webinars and consultations with a specific date, the right of withdrawal is excluded under Section 1837(j) of the Czech Civil Code. [TO BE COMPLETED: any voluntary cancellation policy.]

7. Complaints

Rights arising from defective performance are governed by the Czech Civil Code. Defects in the digital content (e.g. non-functional access, missing content) should be reported by e-mail to focuspeople@focuspeople.eu with a description of the defect and the order number.

The provider will resolve the complaint without undue delay, no later than 30 days after it is raised, and will inform the customer by e-mail.

8. Out-of-court dispute resolution

The Czech Trade Inspection Authority (Česká obchodní inspekce), Štěpánská 796/44, 110 00 Prague 1, www.coi.cz, is competent for the out-of-court resolution of consumer disputes. Disputes may also be resolved via the European ODR platform at ec.europa.eu/consumers/odr.

9. Licence

All platform content is protected by copyright. By purchasing a service the customer obtains a personal, non-transferable licence to use the content for their own needs. Sharing the account, credentials, or content with third parties is prohibited and may lead to access being revoked without compensation.

10. Account closure

The customer may close their learner account from the Profile page. Closure ends access to purchased content immediately and is not a refund. Invoices and paid order records are retained as required by accounting and tax law. Staff accounts cannot be closed in the product.

11. Personal data

Information about the processing of personal data is provided in the separate Privacy Policy available in the platform footer.

12. Final provisions

The contractual relationship is governed by the laws of the Czech Republic. The provider may reasonably amend these terms; the version effective at the time an order is placed applies to that order.

These terms are drawn up in Czech and English; in the event of a discrepancy, the Czech version prevails.
